建設工程價款優先受償權能否直接在法院執行程序中進行確認?

  建(jian)設(she)(she)工(gong)(gong)程(cheng)價(jia)(jia)款(kuan)優(you)(you)(you)先受(shou)(shou)償(chang)權(quan)(quan)(quan)具有優(you)(you)(you)于(yu)抵押權(quan)(quan)(quan)和(he)其他債權(quan)(quan)(quan)的(de)(de)特性(xing),因此在(zai)(zai)工(gong)(gong)程(cheng)款(kuan)糾紛中對承(cheng)包(bao)人有著(zhu)無可比擬的(de)(de)重要性(xing)。然而,現實中經常遇到(dao)的(de)(de)一種情形(xing)是(shi):承(cheng)包(bao)人起訴發包(bao)人要求(qiu)支付欠付工(gong)(gong)程(cheng)款(kuan),并(bing)主(zhu)張(zhang)在(zai)(zai)工(gong)(gong)程(cheng)款(kuan)范圍內對案涉工(gong)(gong)程(cheng)享有建(jian)設(she)(she)工(gong)(gong)程(cheng)價(jia)(jia)款(kuan)優(you)(you)(you)先受(shou)(shou)償(chang)權(quan)(quan)(quan);訴訟過程(cheng)中,各方在(zai)(zai)法院主(zhu)持下達成調(diao)解,就(jiu)工(gong)(gong)程(cheng)款(kuan)數額及付款(kuan)方式達成一致意見(jian),但法院不(bu)同(tong)意在(zai)(zai)調(diao)解書(shu)(shu)中納入建(jian)設(she)(she)工(gong)(gong)程(cheng)價(jia)(jia)款(kuan)優(you)(you)(you)先受(shou)(shou)償(chang)權(quan)(quan)(quan)的(de)(de)內容(rong)①。調(diao)解書(shu)(shu)中未(wei)納入建(jian)設(she)(she)工(gong)(gong)程(cheng)價(jia)(jia)款(kuan)優(you)(you)(you)先受(shou)(shou)償(chang)權(quan)(quan)(quan)是(shi)否視(shi)為(wei)承(cheng)包(bao)人放棄了該權(quan)(quan)(quan)利?如果后續發包(bao)人不(bu)履行(xing)調(diao)解書(shu)(shu),承(cheng)包(bao)人能否在(zai)(zai)向法院申(shen)請強(qiang)制執行(xing)時一并(bing)要求(qiu)確認建(jian)設(she)(she)工(gong)(gong)程(cheng)價(jia)(jia)款(kuan)優(you)(you)(you)先受(shou)(shou)償(chang)權(quan)(quan)(quan)?本文擬就(jiu)前述(shu)問題進行(xing)梳理探討。


  ①一(yi)方面(mian)因為實踐中(zhong)對于(yu)能(neng)否以(yi)調(diao)(diao)解書(shu)的(de)(de)(de)形式(shi)確(que)認(ren)建(jian)設(she)工程價(jia)款優(you)(you)先(xian)受償權(quan)(quan)(quan)尚未形成完全統一(yi)的(de)(de)(de)意見;另一(yi)方面(mian)要(yao)(yao)確(que)認(ren)建(jian)設(she)工程價(jia)款優(you)(you)先(xian)受償權(quan)(quan)(quan)要(yao)(yao)求法(fa)院需(xu)對案件實體內容有(you)一(yi)定(ding)的(de)(de)(de)審查,因此法(fa)院常(chang)常(chang)不(bu)同意在調(diao)(diao)解書(shu)中(zhong)納入建(jian)設(she)工程價(jia)款優(you)(you)先(xian)受償權(quan)(quan)(quan)的(de)(de)(de)內容。值得注意的(de)(de)(de)是,最(zui)高人(ren)(ren)民(min)法(fa)院已在(2019)最(zui)高法(fa)民(min)申(shen)275號民(min)事(shi)裁定(ding)書(shu)中(zhong)明(ming)確(que),“建(jian)設(she)工程價(jia)款優(you)(you)先(xian)受償權(quan)(quan)(quan)系法(fa)定(ding)優(you)(you)先(xian)權(quan)(quan)(quan),對于(yu)在人(ren)(ren)民(min)法(fa)院調(diao)(diao)解書(shu)中(zhong)明(ming)確(que)建(jian)設(she)工程價(jia)款享有(you)優(you)(you)先(xian)受償權(quan)(quan)(quan)的(de)(de)(de)情(qing)形,法(fa)律(lv)及(ji)司法(fa)解釋(shi)并(bing)未予(yu)以(yi)禁止。故(gu)原判(pan)決(jue)認(ren)定(ding)相(xiang)關民(min)事(shi)調(diao)(diao)解書(shu)確(que)認(ren)卓越公司對廠房(fang)基礎的(de)(de)(de)變賣(mai)、拍賣(mai)款享有(you)優(you)(you)先(xian)受償權(quan)(quan)(quan)并(bing)未違反法(fa)律(lv)、法(fa)規(gui)(gui)及(ji)司法(fa)解釋(shi)的(de)(de)(de)強制性規(gui)(gui)定(ding),適(shi)用(yong)法(fa)律(lv)并(bing)無不(bu)當。”


  首先(xian),最(zui)高人(ren)(ren)民法(fa)(fa)院(yuan)在(2007)執他字第11號(hao)《關于對人(ren)(ren)民法(fa)(fa)院(yuan)調解書中未(wei)寫(xie)明(ming)建設工(gong)程(cheng)(cheng)款有優(you)(you)先(xian)受權(quan)應如何適用法(fa)(fa)律問題的請示的復函(han)》中特(te)別明(ming)確:“建設工(gong)程(cheng)(cheng)款優(you)(you)先(xian)受償(chang)(chang)權(quan)是一種法(fa)(fa)定優(you)(you)先(xian)權(quan),無需當事人(ren)(ren)另外予以明(ming)示。”即,調解書中未(wei)載明(ming)建設工(gong)程(cheng)(cheng)價款優(you)(you)先(xian)受償(chang)(chang)權(quan)的內(nei)容(rong)不影響承(cheng)包人(ren)(ren)另行主張建設工(gong)程(cheng)(cheng)價款優(you)(you)先(xian)受償(chang)(chang)權(quan)。


  其次,《最高(gao)人(ren)(ren)民(min)法院(yuan)(yuan)關(guan)于(yu)適用<中(zhong)華人(ren)(ren)民(min)共(gong)和國(guo)民(min)事訴訟法>的(de)(de)解釋(shi)》第(di)五百零六條(tiao)第(di)二款規(gui)定(ding),“對人(ren)(ren)民(min)法院(yuan)(yuan)查封、扣押(ya)、凍結(jie)的(de)(de)財產有優(you)(you)先(xian)權(quan)(quan)、擔保物權(quan)(quan)的(de)(de)債權(quan)(quan)人(ren)(ren),可(ke)(ke)以(yi)直(zhi)接申請參與分配(pei),主(zhu)張優(you)(you)先(xian)受(shou)(shou)償(chang)權(quan)(quan)。”《最高(gao)人(ren)(ren)民(min)法院(yuan)(yuan)關(guan)于(yu)建設(she)工程(cheng)(cheng)(cheng)價款優(you)(you)先(xian)受(shou)(shou)償(chang)權(quan)(quan)問題的(de)(de)批復》(法釋(shi)〔2002〕16號,現(xian)已(yi)失效)也提到,“人(ren)(ren)民(min)法院(yuan)(yuan)在審理(li)房地(di)產糾紛案件和辦(ban)理(li)執行案件中(zhong),應當依照《中(zhong)華人(ren)(ren)民(min)共(gong)和國(guo)合(he)同(tong)法》第(di)二百八十六條(tiao)的(de)(de)規(gui)定(ding),認(ren)定(ding)建筑(zhu)工程(cheng)(cheng)(cheng)的(de)(de)承包人(ren)(ren)的(de)(de)優(you)(you)先(xian)受(shou)(shou)償(chang)權(quan)(quan)優(you)(you)于(yu)抵押(ya)權(quan)(quan)和其他債權(quan)(quan)。”即(ji),建設(she)工程(cheng)(cheng)(cheng)價款優(you)(you)先(xian)受(shou)(shou)償(chang)權(quan)(quan)可(ke)(ke)以(yi)直(zhi)接在執行程(cheng)(cheng)(cheng)序中(zhong)進行確認(ren)。


  實踐中(zhong)(zhong),最高(gao)人(ren)(ren)民(min)法(fa)(fa)院也明(ming)確(que)(que)表示:“人(ren)(ren)民(min)法(fa)(fa)院在(zai)判(pan)決書(shu)、調解書(shu)中(zhong)(zhong)未(wei)明(ming)確(que)(que)建(jian)(jian)(jian)設工(gong)程(cheng)(cheng)(cheng)(cheng)款(kuan)(kuan)享(xiang)有(you)優先(xian)受(shou)償(chang)(chang)(chang)權(quan)的,并不妨(fang)礙權(quan)利人(ren)(ren)申請行使(shi)其(qi)優先(xian)受(shou)償(chang)(chang)(chang)的權(quan)利。”[ 最高(gao)人(ren)(ren)民(min)法(fa)(fa)院,(2016)最高(gao)法(fa)(fa)民(min)申1281號(hao),中(zhong)(zhong)國(guo)銀行股(gu)份有(you)限公(gong)(gong)司江門分(fen)行、廣(guang)東中(zhong)(zhong)人(ren)(ren)集團(tuan)建(jian)(jian)(jian)設有(you)限公(gong)(gong)司等執(zhi)行分(fen)配方(fang)案(an)異(yi)議之訴(su)民(min)事裁定書(shu) ]“承(cheng)包人(ren)(ren)向執(zhi)行法(fa)(fa)院主張其(qi)對建(jian)(jian)(jian)設工(gong)程(cheng)(cheng)(cheng)(cheng)享(xiang)有(you)建(jian)(jian)(jian)設工(gong)程(cheng)(cheng)(cheng)(cheng)價款(kuan)(kuan)優先(xian)受(shou)償(chang)(chang)(chang)權(quan)的,屬于行使(shi)建(jian)(jian)(jian)設工(gong)程(cheng)(cheng)(cheng)(cheng)價款(kuan)(kuan)優先(xian)受(shou)償(chang)(chang)(chang)權(quan)的合法(fa)(fa)方(fang)式。”[ 最高(gao)人(ren)(ren)民(min)法(fa)(fa)院指導(dao)案(an)例171號(hao),(2019)最高(gao)法(fa)(fa)民(min)終255號(hao),中(zhong)(zhong)天建(jian)(jian)(jian)設集團(tuan)有(you)限公(gong)(gong)司訴(su)河南恒和置業有(you)限公(gong)(gong)司建(jian)(jian)(jian)設工(gong)程(cheng)(cheng)(cheng)(cheng)施(shi)工(gong)合同糾紛案(an)綜上(shang),即使(shi)調解書(shu)中(zhong)(zhong)未(wei)載明(ming)建(jian)(jian)(jian)設工(gong)程(cheng)(cheng)(cheng)(cheng)價款(kuan)(kuan)優先(xian)受(shou)償(chang)(chang)(chang)權(quan)相關內容,承(cheng)包人(ren)(ren)仍(reng)可以直(zhi)接向執(zhi)行法(fa)(fa)院主張確(que)(que)認享(xiang)有(you)建(jian)(jian)(jian)設工(gong)程(cheng)(cheng)(cheng)(cheng)價款(kuan)(kuan)優先(xian)受(shou)償(chang)(chang)(chang)權(quan)。


  債權金額明(ming)確(que)(que),即(ji)承包(bao)人(ren)(ren)主張優(you)(you)(you)(you)先(xian)(xian)(xian)受償(chang)(chang)(chang)權的(de)范(fan)圍(wei)明(ming)確(que)(que),是承包(bao)人(ren)(ren)能否在(zai)執(zhi)(zhi)(zhi)行(xing)程(cheng)序(xu)中(zhong)成功確(que)(que)認享(xiang)有建設工(gong)程(cheng)價(jia)款優(you)(you)(you)(you)先(xian)(xian)(xian)受償(chang)(chang)(chang)權的(de)前提。最(zui)高人(ren)(ren)民(min)法(fa)(fa)(fa)院在(zai)(2019)最(zui)高法(fa)(fa)(fa)執(zhi)(zhi)(zhi)監359號(hao)河北雙(shuang)維(wei)集團有限公(gong)司、劉忠利民(min)間借貸(dai)糾紛執(zhi)(zhi)(zhi)行(xing)審(shen)(shen)查(cha)類執(zhi)(zhi)(zhi)行(xing)裁定書中(zhong)明(ming)確(que)(que):“當承包(bao)人(ren)(ren)在(zai)執(zhi)(zhi)(zhi)行(xing)程(cheng)序(xu)中(zhong)提出(chu)享(xiang)有建設工(gong)程(cheng)優(you)(you)(you)(you)先(xian)(xian)(xian)受償(chang)(chang)(chang)權的(de)主張時,執(zhi)(zhi)(zhi)行(xing)法(fa)(fa)(fa)院應予(yu)充分關(guan)注并先(xian)(xian)(xian)行(xing)審(shen)(shen)查(cha),在(zai)拍(pai)賣(mai)、抵債或者分配程(cheng)序(xu)中(zhong)依(yi)法(fa)(fa)(fa)保護其合(he)法(fa)(fa)(fa)權益。如(ru)果(guo)其尚未取(qu)得建設工(gong)程(cheng)優(you)(you)(you)(you)先(xian)(xian)(xian)受償(chang)(chang)(chang)權的(de)執(zhi)(zhi)(zhi)行(xing)依(yi)據,通(tong)過審(shen)(shen)查(cha)建設工(gong)程(cheng)施(shi)工(gong)合(he)同等證據仍無法(fa)(fa)(fa)確(que)(que)定優(you)(you)(you)(you)先(xian)(xian)(xian)受償(chang)(chang)(chang)權范(fan)圍(wei)的(de),可以告知承包(bao)人(ren)(ren)盡快通(tong)過訴訟程(cheng)序(xu)取(qu)得優(you)(you)(you)(you)先(xian)(xian)(xian)受償(chang)(chang)(chang)權的(de)執(zhi)(zhi)(zhi)行(xing)依(yi)據。”


  同時,最高人民法(fa)院還在(zai)該案中明(ming)確(que),“若邯鄲中院確(que)實無法(fa)在(zai)執(zhi)行(xing)程(cheng)序中確(que)定雙維(wei)(wei)集(ji)團(tuan)是(shi)否享有(you)優先(xian)受(shou)(shou)償權(quan)以及范圍,至少在(zai)作出以物抵(di)債(zhai)裁定前,應先(xian)對雙維(wei)(wei)集(ji)團(tuan)的工(gong)程(cheng)價款作出預留,待雙維(wei)(wei)集(ji)團(tuan)通(tong)過(guo)訴訟(song)途徑(jing)明(ming)確(que)優先(xian)受(shou)(shou)償權(quan)的范圍后予以分配,而非不顧(gu)雙維(wei)(wei)集(ji)團(tuan)的優先(xian)受(shou)(shou)償權(quan),徑(jing)直將執(zhi)行(xing)標的抵(di)債(zhai)給(gei)申請執(zhi)行(xing)人。”


  即,如(ru)承(cheng)(cheng)包人未就建設(she)工(gong)(gong)程(cheng)價款(kuan)(kuan)(kuan)(kuan)優先(xian)受(shou)償(chang)權覆(fu)蓋的(de)工(gong)(gong)程(cheng)款(kuan)(kuan)(kuan)(kuan)金額與發包人達成一致意見,徑(jing)直向執(zhi)行法(fa)院主(zhu)張(zhang)建設(she)工(gong)(gong)程(cheng)價款(kuan)(kuan)(kuan)(kuan)優先(xian)受(shou)償(chang)權,而執(zhi)行法(fa)院經審查仍無法(fa)確(que)定優先(xian)受(shou)償(chang)權范(fan)圍的(de),承(cheng)(cheng)包人仍需(xu)通過訴訟(song)途徑(jing)對(dui)工(gong)(gong)程(cheng)款(kuan)(kuan)(kuan)(kuan)金額進行明確(que)。與此同(tong)時,因(yin)承(cheng)(cheng)包人已向執(zhi)行法(fa)院主(zhu)張(zhang)建設(she)工(gong)(gong)程(cheng)價款(kuan)(kuan)(kuan)(kuan)優先(xian)受(shou)償(chang)權,執(zhi)行法(fa)院應當對(dui)相應的(de)工(gong)(gong)程(cheng)款(kuan)(kuan)(kuan)(kuan)作出預留(liu),待承(cheng)(cheng)包人經訴訟(song)確(que)認優先(xian)受(shou)償(chang)權范(fan)圍后進行款(kuan)(kuan)(kuan)(kuan)項(xiang)分配。


  最高人民(min)(min)法院在民(min)(min)事(shi)審判(pan)第一(yi)庭編寫的《民(min)(min)事(shi)審判(pan)實務問答(da)》(法律出(chu)版社,2021年(nian)7月第1版,第58頁(ye))一(yi)書中,也對“未(wei)經(jing)訴訟直接向執(zhi)行機構主張建(jian)設工程(cheng)優先權的,執(zhi)行機構應當如何處(chu)理?”這一(yi)問題進行了(le)具體回答(da):


  “法(fa)院在執行(xing)程(cheng)序中(zhong)收(shou)到承包人(ren)(ren)要(yao)求(qiu)行(xing)使(shi)未經生效法(fa)律文書確(que)認的(de)(de)(de)(de)建設(she)(she)工(gong)(gong)程(cheng)優先權(quan)申請(qing)的(de)(de)(de)(de),可分(fen)兩種情況予以處理:一(yi)是(shi)如果被(bei)執行(xing)人(ren)(ren)對(dui)其(qi)(qi)申請(qing)的(de)(de)(de)(de)工(gong)(gong)程(cheng)款(kuan)金額無(wu)異議(yi),且(qie)經法(fa)院審查承包人(ren)(ren)提(ti)供的(de)(de)(de)(de)建設(she)(she)工(gong)(gong)程(cheng)合(he)同及相(xiang)關材料(liao)合(he)法(fa)有(you)(you)效,亦(yi)未發現承包人(ren)(ren)和(he)被(bei)執行(xing)人(ren)(ren)惡意串通損害國(guo)家(jia)、集(ji)體和(he)第(di)三人(ren)(ren)利(li)益的(de)(de)(de)(de),應(ying)準許其(qi)(qi)優先受償;二是(shi)如果被(bei)執行(xing)人(ren)(ren)對(dui)其(qi)(qi)申請(qing)的(de)(de)(de)(de)工(gong)(gong)程(cheng)款(kuan)金額有(you)(you)異議(yi),法(fa)院應(ying)當告知承包人(ren)(ren)另行(xing)訴訟,但法(fa)院對(dui)工(gong)(gong)程(cheng)變價款(kuan)的(de)(de)(de)(de)分(fen)配(pei)程(cheng)序須待訴訟有(you)(you)結果后方可進(jin)行(xing)。”


  筆者在(zai)(zai)(zai)(zai)《九匯(hui)看法|建(jian)設(she)工(gong)程(cheng)(cheng)(cheng)(cheng)價(jia)(jia)款(kuan)優先(xian)受償(chang)權(quan)(quan)的(de)行使(shi)期限及(ji)起(qi)算點(dian)》一文(wen)中曾對建(jian)設(she)工(gong)程(cheng)(cheng)(cheng)(cheng)價(jia)(jia)款(kuan)優先(xian)受償(chang)權(quan)(quan)的(de)行使(shi)期限及(ji)起(qi)算點(dian)相關問題進行了(le)基本的(de)梳理。但在(zai)(zai)(zai)(zai)明確行使(shi)期限及(ji)起(qi)算點(dian)后(hou),承(cheng)包人(ren)(ren)主張建(jian)設(she)工(gong)程(cheng)(cheng)(cheng)(cheng)價(jia)(jia)款(kuan)優先(xian)受償(chang)權(quan)(quan)還(huan)會涉及(ji)一個問題,即(ji):承(cheng)包人(ren)(ren)到底是(shi)在(zai)(zai)(zai)(zai)何時(shi)(shi)行使(shi)了(le)主張建(jian)設(she)工(gong)程(cheng)(cheng)(cheng)(cheng)價(jia)(jia)款(kuan)優先(xian)受償(chang)權(quan)(quan)的(de)權(quan)(quan)利?尤其在(zai)(zai)(zai)(zai)遇(yu)到承(cheng)包人(ren)(ren)起(qi)訴(su)(su)時(shi)(shi)主張了(le)建(jian)設(she)工(gong)程(cheng)(cheng)(cheng)(cheng)價(jia)(jia)款(kuan)優先(xian)受償(chang)權(quan)(quan),但最終形成的(de)調(diao)解書未(wei)載明建(jian)設(she)工(gong)程(cheng)(cheng)(cheng)(cheng)價(jia)(jia)款(kuan)優先(xian)受償(chang)權(quan)(quan),因而承(cheng)包人(ren)(ren)又需在(zai)(zai)(zai)(zai)執行程(cheng)(cheng)(cheng)(cheng)序中進行主張的(de)情(qing)形時(shi)(shi),該建(jian)設(she)工(gong)程(cheng)(cheng)(cheng)(cheng)價(jia)(jia)款(kuan)優先(xian)受償(chang)權(quan)(quan)的(de)行使(shi)時(shi)(shi)間(jian)點(dian)究竟該如何認定?是(shi)以起(qi)訴(su)(su)時(shi)(shi)間(jian)為準,還(huan)是(shi)以執行程(cheng)(cheng)(cheng)(cheng)序中的(de)主張優先(xian)受償(chang)權(quan)(quan)的(de)時(shi)(shi)間(jian)為準?


  江(jiang)蘇(su)(su)省(sheng)高(gao)級人(ren)民法院在(2015)蘇(su)(su)執復字第00046號(hao)江(jiang)蘇(su)(su)霖安建設(she)工程有限公司、金漪等小(xiao)額借款合同糾紛(fen)(fen)、企業借貸糾紛(fen)(fen)等執行(xing)(xing)裁定書中采納了以起訴時(shi)間作為承包人(ren)行(xing)(xing)使(shi)建設(she)工程價(jia)款優(you)先受償權的時(shi)間的意見(jian),筆者亦贊同江(jiang)蘇(su)(su)高(gao)院的該種觀(guan)點:


  “雖然在(zai)(zai)(2014)新(xin)民初字第2079號(hao)民事(shi)調(diao)解(jie)書(shu)中(zhong)(zhong),霖(lin)安(an)(an)(an)公(gong)司(si)(si)并(bing)未(wei)明(ming)(ming)(ming)確對(dui)建設(she)(she)工(gong)程(cheng)(cheng)款(kuan)的(de)(de)優先(xian)受(shou)償(chang)權(quan)(quan)(quan)(quan)請(qing)(qing)求,但(dan)霖(lin)安(an)(an)(an)公(gong)司(si)(si)在(zai)(zai)民事(shi)起訴狀中(zhong)(zhong)提(ti)出訴訟(song)請(qing)(qing)求之一就(jiu)是:請(qing)(qing)求依法(fa)判令(ling)其享(xiang)有(you)工(gong)程(cheng)(cheng)價(jia)款(kuan)的(de)(de)優先(xian)受(shou)償(chang)權(quan)(quan)(quan)(quan),且霖(lin)安(an)(an)(an)公(gong)司(si)(si)在(zai)(zai)2014年9月(yue)21日(ri)(ri)向(xiang)常州中(zhong)(zhong)院(yuan)(yuan)提(ti)交的(de)(de)“暫緩(huan)分配拍賣房(fang)產所得申請(qing)(qing)書(shu)”中(zhong)(zhong)亦再(zai)次(ci)提(ti)出其對(dui)建設(she)(she)工(gong)程(cheng)(cheng)款(kuan)享(xiang)有(you)優先(xian)受(shou)償(chang)權(quan)(quan)(quan)(quan)。根據最高人民法(fa)院(yuan)(yuan)《關于(yu)建設(she)(she)工(gong)程(cheng)(cheng)價(jia)款(kuan)優先(xian)受(shou)償(chang)權(quan)(quan)(quan)(quan)問題的(de)(de)批復》第四條規定(ding)(ding),建設(she)(she)工(gong)程(cheng)(cheng)承包人行使(shi)優先(xian)權(quan)(quan)(quan)(quan)的(de)(de)期限(xian)為六(liu)個月(yue),自建設(she)(she)工(gong)程(cheng)(cheng)竣工(gong)之日(ri)(ri)或建設(she)(she)工(gong)程(cheng)(cheng)合同約定(ding)(ding)的(de)(de)竣工(gong)之日(ri)(ri)起計算。本案中(zhong)(zhong),霖(lin)安(an)(an)(an)公(gong)司(si)(si)起訴時已提(ti)出行使(shi)優先(xian)受(shou)償(chang)權(quan)(quan)(quan)(quan)的(de)(de)主張,滿足六(liu)個月(yue)內行使(shi)權(quan)(quan)(quan)(quan)利主張的(de)(de)期限(xian)要求,且(2014)新(xin)民初字第2079號(hao)民事(shi)調(diao)解(jie)書(shu)中(zhong)(zhong)也明(ming)(ming)(ming)確新(xin)業公(gong)司(si)(si)結欠霖(lin)安(an)(an)(an)公(gong)司(si)(si)的(de)(de)款(kuan)項(xiang)為工(gong)程(cheng)(cheng)款(kuan)。建設(she)(she)工(gong)程(cheng)(cheng)款(kuan)的(de)(de)優先(xian)受(shou)償(chang)權(quan)(quan)(quan)(quan)是一項(xiang)法(fa)定(ding)(ding)權(quan)(quan)(quan)(quan)利,只(zhi)要權(quan)(quan)(quan)(quan)利人未(wei)明(ming)(ming)(ming)確放棄,即為享(xiang)有(you)該項(xiang)權(quan)(quan)(quan)(quan)利。故霖(lin)安(an)(an)(an)公(gong)司(si)(si)不因未(wei)在(zai)(zai)調(diao)解(jie)書(shu)中(zhong)(zhong)明(ming)(ming)(ming)確該項(xiang)權(quan)(quan)(quan)(quan)利而喪失優先(xian)受(shou)償(chang)權(quan)(quan)(quan)(quan)。”


  【結 語】


  調(diao)解(jie)書(shu)中未納入建(jian)設(she)工(gong)(gong)程(cheng)價(jia)款(kuan)優先(xian)(xian)受(shou)償(chang)權(quan)(quan)的內容不影響(xiang)承包(bao)人(ren)直接向執行(xing)法(fa)院(yuan)(yuan)主張(zhang)確認建(jian)設(she)工(gong)(gong)程(cheng)價(jia)款(kuan)優先(xian)(xian)受(shou)償(chang)權(quan)(quan)。但需要(yao)注意(yi)的是(shi),為避(bi)免(mian)后續因(yin)建(jian)設(she)工(gong)(gong)程(cheng)價(jia)款(kuan)優先(xian)(xian)受(shou)償(chang)權(quan)(quan)的行(xing)使期(qi)限產(chan)生爭(zheng)議,承包(bao)人(ren)應盡可能(neng)縮短調(diao)解(jie)書(shu)中發(fa)包(bao)人(ren)的付款(kuan)期(qi)限。如發(fa)包(bao)人(ren)已(yi)因(yin)其(qi)他(ta)債(zhai)權(quan)(quan)進入執行(xing)程(cheng)序的,承包(bao)人(ren)在訴訟調(diao)解(jie)的同時,可以(yi)向執行(xing)法(fa)院(yuan)(yuan)提出(chu)建(jian)設(she)工(gong)(gong)程(cheng)價(jia)款(kuan)優先(xian)(xian)受(shou)償(chang)權(quan)(quan)的主張(zhang),要(yao)求執行(xing)法(fa)院(yuan)(yuan)暫緩分配,以(yi)更好地保障自(zi)身的權(quan)(quan)益(yi)。
